1. Who we are

GO CREAjt is software by CREAJT, a creative agency in Nijmegen, the Netherlands. GO CREAjt is a trade name of CREAJT, Sint Annastraat 37A, 6524 EE Nijmegen, the Netherlands, Chamber of Commerce (KvK) 99234017, VAT NL005377107B89. In these terms we are called "we" or "us". You can reach us at info@gocreajt.com.

2. When these terms apply

  • These terms apply to every use of GO CREAjt: the website, the web app, the client portal and the apps for iPhone, iPad and (soon) Android.
  • You accept them when you create an account or agency, start a trial, take out a subscription or use the service.
  • GO CREAjt is for business use only: for creative agencies, studios and freelancers. Consumer withdrawal rights therefore do not apply; instead, you can try GO CREAjt for free first.
  • Our privacy policy, our cookie policy and the data processing agreement are part of these terms. Your own general or purchasing terms do not apply.

3. Definitions

  • Service: GO CREAjt, meaning the software, the website, the client portal and the app.
  • Agency or you: the company or freelancer with an account at GO CREAjt. That is our customer.
  • Owner: the person who created the agency, or to whom ownership was transferred.
  • Team member: a person the agency gives access to the service, with their own role and permissions.
  • Client: a client of the agency. A client can get access to their own client portal.
  • Content: everything you, your team or your clients put into the service, such as text, photos, videos, music, documents and data.

4. The service

With GO CREAjt a creative agency manages its work and its clients in one place: content planning and approval, photo galleries, video feedback, projects, tasks, hours, invoices, contracts, analytics and a client portal in the agency's own branding. Every plan includes all features; plans differ only in the number of clients, team members and storage.

Publishing to social media (Instagram, Facebook, TikTok, LinkedIn, YouTube and Threads) is made available step by step. The app shows which connections already work. A connection that is not yet available is not a defect of the service.

We keep developing GO CREAjt and may add, change or remove features. If we remove an important feature you pay for, we tell you at least 30 days in advance and you may cancel.

5. Your account

  • You sign in with your e-mail address and password, or with Google or Apple.
  • You provide correct details and keep them up to date, and you keep your login details secret.
  • You are responsible for everything that happens through your account and the accounts of your team. If you notice misuse, tell us right away.
  • The owner decides who is on the team and which permissions everyone has, takes out the subscription and can cancel it.
  • You invite your clients to their portal yourself, or share a link (for example a review link or a gallery). Anyone with such a link can see its content, so only share links with the right people.

6. Plans, limits and fair use

The current plans, limits and prices are on our pricing page and in the app. When you reach a limit, the app tells you; you can then buy an extra or switch to a larger plan. AI features are subject to fair use. We expect normal use of the service; if you use it much more heavily than usual, we will contact you to find a solution together.

7. Prices and payment

  • All prices are in euros and exclude VAT (21%).
  • You pay in advance, monthly or yearly, through our payment partner Stripe. You authorise Stripe to collect the following amounts automatically.
  • Your subscription renews automatically for a month or a year until you cancel. Invoices are sent by e-mail and are available under Subscription in the app.
  • You take out or change a subscription through the website or web app. Nothing can be bought in the iPhone and iPad app.

8. Changing plans

Upgrades take effect immediately and are charged pro rata for the rest of the current period. Downgrades take effect at the start of the next period; no money is refunded. During a free trial every change takes effect immediately.

9. Free trial

A new agency can try GO CREAjt for free for the first month; each agency gets one free trial. After the trial the subscription starts automatically unless you cancel before the last day of the trial. We send a reminder about 7 days before the trial ends.

10. Test phase and GO Crew

During the test phase you can only create an agency with a GO Crew code, and GO Crew members use the service for free and without limits. More can change during this phase and things may go wrong more often. We announce the end of the test phase in advance.

11. Discounts and referrals

One discount applies per subscription at a time; discounts cannot be exchanged for money. Referral credit is only set off against your own future invoices while you have a paid subscription. In case of misuse, such as fake accounts, we may refuse or withdraw a discount or credit.

12. Failed payments

If a payment fails, Stripe retries automatically and you are notified. You then have 7 days during which everything keeps working. If payment is still missing after that, the agency is locked until the payment is completed. If payment fails after the last attempt, we may end the subscription. Amounts due remain due.

13. Cancelling

  • The owner can cancel at any time under Subscription in the app.
  • The subscription continues until the end of the period already paid; we do not refund (part of) a month or year.
  • After it ends, the agency is locked. We keep the data for a while so you can continue later without loss (see article 17).

14. Your content

  • Your content remains yours or your clients'. We do not become its owner.
  • You allow us to store, process and show your content as far as needed to provide the service, for example to make previews, show files in the client portal and publish posts to the channels you choose. This permission lasts as long as your content is in the service.
  • We do not use your content for other purposes. We do not sell it and do not use it to train AI models.
  • You make sure you have the right to use and share your content, including music and people who are recognisable in images.

15. What is not allowed

You do not use GO CREAjt for anything that breaks the law, these terms, the terms of a connected platform or the rights of others. Among other things, you may not publish unlawful, misleading, discriminatory or infringing content; send spam; disrupt, overload or hack the service or bypass security or limits; resell the service without our permission; or upload malicious software. If you do, we may remove content, limit your access or suspend your account, where reasonable after a warning.

16. Your clients and the client portal

You are responsible for your agreements with your own clients; we are not a party to them. Invoices, contracts and reminders you create or send through GO CREAjt are yours and are sent in your name. For your clients' personal data you are the controller and we are the processor, under our data processing agreement.

17. Exporting, keeping and deleting your data

  • While you have access, you can download your data under Preferences in the app ("Download all your data").
  • After a subscription ends, we keep the agency locked for 12 months and then delete it after an e-mail warning.
  • You can delete your own account in your profile, and the owner can request deletion of the whole agency. Deletion cannot be undone. See how to delete your data.
  • Data we must keep by law, such as our own invoices to you, we keep as long as the law requires.

18. AI features

Some features use AI, such as suggesting captions and ideas and reading invoices and contracts. AI can make mistakes. Always check the result before you publish, send or use it. You remain responsible for what you do with it.

19. Connections with other services and platforms

GO CREAjt works with services of others, such as social media platforms, Stripe, Google and Apple. For publishing to social media we use our processor Post for Me. Their own terms also apply, and you comply with them. In particular:

We are not responsible for what those services do, for example when a platform changes its rules or connections, refuses a post, stops providing metrics or blocks an account.

20. Availability, maintenance and support

We do our best to keep GO CREAjt working well, but we do not promise uninterrupted operation or a fixed uptime. Planned maintenance is announced in advance where possible; the current status is on our status page. Support is available through the help centre, the help button in the app and by e-mail; we usually reply within one business day.

21. Intellectual property

The software, design, texts and the GO CREAjt brand belong to us or our licensors. You get a non-exclusive, non-transferable right to use the service while your subscription or trial runs. Your content remains yours (article 14).

22. Liability

  • We are only liable for direct damage caused by us not properly meeting our obligations, after you have given us written notice and a reasonable period to fix it.
  • We are not liable for indirect damage, such as consequential loss, lost revenue or profit, reputational damage, business interruption or loss of data, nor for damage caused by services of others (article 19), by your or your clients' content, or by AI output you did not check.
  • Our total liability is limited to the amount (excluding VAT) you paid us in the 3 months before the event that caused the damage, or at most € 100 if you use the service for free.
  • These limits do not apply in case of intent or deliberate recklessness of our management. A claim lapses if not reported to us within 12 months after you discovered the damage.

23. Indemnity

If someone holds us liable because of your content or because you or your team used the service in breach of these terms or the law, you compensate us for the resulting damage and costs.

24. Force majeure

If we cannot meet our obligations because of something outside our control, such as an outage at a supplier or platform, a power or internet failure, a cyberattack or a government measure, we are temporarily released from them. If force majeure lasts longer than 60 days, either of us may end the subscription.

25. Suspension and termination by us

We may suspend access or end an account if you do not pay, breach these terms or if the law requires it, where reasonable after giving you a chance to fix it. If we stop GO CREAjt altogether, we announce this at least 3 months in advance and refund anything paid in advance for the period after that.

26. Changes to prices and terms

We may change our prices and these terms. We announce price changes and important changes to these terms at least 30 days in advance by e-mail; you may cancel before they take effect. The date and version of the current terms are shown at the top.

27. The app in the App Store and Google Play

The GO CREAjt app is free to download; you need an account to use it and there are no in-app purchases. The terms of the app store also apply. The agreement about the app is between you and us, not Apple or Google, who are not responsible for the app, its maintenance, support or claims about it. Apple and its subsidiaries may enforce these terms against you as far as they concern the iPhone and iPad app.

28. Other provisions

We may send you messages about your account and the service by e-mail or in the app. You may not transfer your rights and obligations without our permission; we may, for example in a takeover, with your rights staying the same. If part of these terms is invalid, the rest remains in force.

29. Governing law and disputes

Dutch law applies to these terms and to the use of GO CREAjt; the Vienna Sales Convention does not. If you have a complaint, e-mail us first. If we cannot solve it together, disputes are submitted to the competent court of the District Court of Gelderland. This is a translation of our Dutch algemene voorwaarden; if the two differ, the Dutch version prevails.
